    These Terms of Service ("Terms") are entered into between Lampsy Health, Lda., a company duly incorporated in accordance with the laws of Portugal, with its registered office at Rua da Prata, 80, Lisbon, with the share capital of €100.00, under the single registration and VAT number PT518448851 ("Lampsy", "we", "us", or "our") and you, the user ("you" or "the User"). These Terms govern the purchase, delivery, and use of the Lampsy System and its associated App, Device, and services (collectively, "the Service"). By purchasing a Lampsy Device from our official website (https://lampsyhealth.com), possible subsidiary or official third party reseller or by using the App and Device, you agree to be bound by these Terms.

    Please read these Terms carefully alongside Lampsy's Privacy Policy (https://lampsyhealth.com/privacy-policy) before making a purchase, downloading, installing, or using the App, Device, or Subscription Service. If you do not agree with any part of these Terms, do not complete your purchase or use the Lampsy service.

    1. Definitions

    "Abnormal Movement" shall mean a movement pattern detected by the Lampsy System that is consistent with a tonic-clonic seizure or other movement patterns within the Device's detection capabilities.

    "Agreement" shall mean these Terms of Service which govern the purchase and use of the Lampsy System by the User, as may be amended by Lampsy from time to time as specified herein.

    "App" shall mean the Lampsy mobile application, a Software Component of the Lampsy System, which may be downloaded from Google Play Store or Apple App Store and used with a compatible Mobile Device.

    "Caregiver(s)" shall mean the person(s) approved by and designated by the User to receive calls and/or SMS messages, or notifications via the App, and/or any person who configures, manages, or operates the Lampsy System on behalf of a Person with Epilepsy.

    "Device" shall mean the Lampsy Device, the hardware component of the Lampsy System, produced by Lampsy, capable of collecting and analyzing video footage for subtle lighting changes that allow the detection and communication of Abnormal Movements to the App.

    "Instructions for Use" shall mean the user manual and safety guidance provided by Lampsy with the Device.

    "Lampsy System" shall mean the Device, the App, and any firmware or software embedded in or associated with them.

    "Mobile Device" shall mean any compatible smartphone or tablet that enables the use of the App.

    "Service" shall mean the provision by Lampsy of the Lampsy System, the Subscription Service, and all associated services, including cloud hosting, customer support, software updates, notification delivery, and the customer portal.

    "Subscription Service" shall mean the monitoring function subscription service available from Lampsy to Users via the App, as further described in Section 4.

    "User" shall mean a Caregiver and/or Person with Epilepsy that uses the Lampsy System (as applicable).

    "Privacy Policy" shall mean the Lampsy Health Privacy Policy setting out how we process personal data in relation to this Agreement, available at https://lampsyhealth.com/privacy-policy.

    2. Purchase of the Lampsy System

    2.1 Ordering Lampsy: Lampsy Device can be purchased through our official website (https://lampsyhealth.com/). To place an order, you will need to provide accurate personal and payment information (see Privacy Policy). All orders are subject to acceptance by Lampsy. When you submit an order on our website, you are making an offer to buy the product under these Terms. We reserve the right to decline or cancel an order for reasons including suspicion of fraud, discovery of an error in pricing or product information, or unavailability of the product. If we accept your order, we will send an order confirmation via email or another durable medium, containing the acceptance of such order, order details, and delivery details. At that point, a binding contract for sale is formed.

    2.2 Pricing and Shipping: Pricing of the Lampsy System and shipping costs are those indicated on our website at the time of submission of your order. Prices and shipping costs are inclusive of all applicable taxes, and duties, unless otherwise expressly specified in the order during the checkout process. We will arrange delivery of the Lampsy Device to the address you provide and aim to deliver your Device as soon as possible, taking into account the delivery method selected. Unless otherwise stated, you'll receive your order no later than 30 days from the date of the order confirmation. If we are unable to deliver within this period, you may request delivery within a reasonable additional period. If we still fail to deliver, you have the right to cancel the order and receive a full refund within 14 days. If the supply of the Device is delayed by an event outside of our control, we shall contact you as soon as possible with an update. Upon delivery, please inspect the package and Device. If you notice any damage or missing items, notify us and the carrier immediately so we can assist in resolving the issue. The risk of loss or damage to the Device passes to you when you or a third party designated by you (other than the carrier) acquires physical possession of the Device.

    2.3 Pre-sales: Lampsy Health may accept pre-sale orders for the Lampsy System before the product is ready for shipment. In such cases, Lampsy may issue an advance invoice for the amount paid at checkout. Shipment and completion of the sale remain subject to Lampsy's ability to fulfil the order in accordance with applicable legal, regulatory, and operational requirements. Once the order is ready for completion, Lampsy will issue the final invoice, and any amount already paid by the customer will be credited against it. Where required by applicable law, Lampsy Health may also issue a credit note for the advance invoice. Due to the nature of a Pre-sale order, delivery may exceed the 30-day period referred to in Section 2.2. Lampsy will inform you of the estimated delivery date at or before the time of purchase. You may cancel a pre-sale order at any time before dispatch and receive a full refund. Please contact support (support@lampsyhealth.com) for further information.

    2.4 Right of Withdrawal (Device): If you purchase the Lampsy Device from our website, you have a legal right to withdraw from the contract (change your mind) without giving any reason within 30 days of the date on which you or a third-party designated by you (other than the carrier) acquires physical possession of the Device, in accordance with the Cancellation Policy below. For the right of withdrawal applicable to Paid Subscriptions, see Section 4.5.

    2.5 Return of Product (Effects of Withdrawal): If you exercise your right of withdrawal in accordance with Section 2.4, valid up to 30 days from the date of delivery, you must send the product back to the return address we designate without undue delay and no later than 14 days from the date you informed us of your withdrawal. You will be responsible for the direct cost of returning the Device, unless we have offered to cover it. We will reimburse all payments received from you, including the standard delivery costs, no later than 14 days from the date on which we are informed of your decision to withdraw. We may withhold the refund until we have received the Device back or until you have supplied evidence of having sent it back, whichever is the earliest. The refund will be made using the same means of payment you used for the initial transaction, unless you expressly agree otherwise and provided that you do not incur any fees as a result of the refund. You may inspect and handle the Device as you would in a shop, but you may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Device. All original accessories, manuals, and packaging should be returned together with the Device to ensure a full refund and that the Device can be refurbished or recycled properly. Failure to include certain items may result in a deduction from the refund equivalent to their replacement cost.

    2.6 Return of Defective Products: If you are returning the Device because it is defective or not as described, this is handled under the legal guarantee of conformity (Section 6) rather than the withdrawal right. Lampsy will cover the cost of return shipping, and you will be entitled to repair, replacement, a price reduction, or a refund in accordance with Section 6. Please contact support through support@lampsyhealth.com if you believe your Lampsy Device is faulty.

    2.7 Changes to Orders and Plans: Any request to change an order, delivery details, subscription tier, billing cycle, or other commercial element of the Service is subject to Lampsy's acceptance. No requested change shall be binding unless confirmed by Lampsy via email (support@lampsyhealth.com), through the customer portal, or through another durable medium. Lampsy Health may refuse requested changes where necessary for operational, technical, legal, fraud-prevention, or regulatory reasons.

    2.8 No Conflicting Purchaser Terms: Any terms and conditions submitted, referenced, or purportedly imposed by the User, including in any purchase order, procurement document, email footer, or other communication, shall not apply unless expressly accepted by Lampsy in writing. These Terms, together with any order confirmation and any specific written commercial terms issued by Lampsy, form the contractual basis for the User's purchase and use of the Service.

    3. End User License

    3.1 License Grant: Subject to these Terms, Lampsy grants the User a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, access, and use the App, and any firmware or software embedded in the Lampsy Device that is made available for normal operation of the Lampsy System within their subscription tier when applicable, solely for the User's private and non-commercial use, solely for the intended purpose of the Lampsy System, and solely in accordance with these Terms, the Instructions for Use, and any applicable safety guidance. This license does not grant you any ownership of the App, the Lampsy System, or any component thereof. All rights not expressly granted under these Terms are reserved by Lampsy.

    3.2 Usage Requirements: The Lampsy System functions as an integrated system. Certain features require: (i) the Lampsy Device, (ii) the Lampsy App, (iii) a compatible Mobile Device, (iv) internet connectivity, and (v), where applicable, an active paid Subscription Service. Unless otherwise stated in these Terms or in the App, cancellation or expiry of a paid subscription may limit access to certain features while allowing continued access to essential functionalities.

    3.3 Lampsy App Requirements: The User is solely responsible for the installation, configuration, maintenance, and security of the Mobile Device, local network, internet connection, and related third-party services used to access the App. Lampsy does not warrant that the App will be compatible with all Mobile Devices, operating systems, or mobile carriers.

    3.4 Software Updates: Lampsy may provide updates, patches, or new versions of the App or the Device firmware from time to time, including updates necessary to maintain the conformity of the Lampsy System with these Terms and with applicable law. All updates are considered part of the Lampsy System and are subject to these Terms. Lampsy reserves the right to modify the App and its content for justified reasons. Where possible, Lampsy will provide reasonable notice of such changes.

    3.5 Restrictions: The User shall use the Lampsy System only within the limits of this Agreement, the intended purpose of the product, and the Instructions for Use. Except as expressly permitted by mandatory law, the User shall not, and shall not permit any third party to: (a) copy, reproduce, republish, distribute, sell, resell, lease, lend, rent, sublicense, or otherwise make available the App, the Device software, or any part of the Lampsy System; (b) alter, adapt, translate, modify, create derivative works of, reverse engineer, decompile, disassemble, decode, or attempt to derive source code from the App, firmware, Device software, algorithms, or technical protection measures used by the Lampsy System; (c) remove, alter, or obscure any copyright, trademark, safety, branding, or proprietary notices; (d) use the Lampsy System with unauthorized accessories or third-party tools intended to interfere with the Service; (e) use the Lampsy System for commercial exploitation, surveillance unrelated to its intended purpose, unlawful monitoring, or any unlawful purpose; (f) transfer or assign rights granted under these Terms without Lampsy's prior written consent; (g) circumvent any technological measure that controls access to the Lampsy System; (h) transmit any malware or harmful software code; (i) interfere with or disrupt the integrity, security, or performance of the Lampsy System.

    3.6 Accounts and Credentials: A Lampsy account may be required to activate, configure, and use some or all features of the Service. The User is responsible for maintaining the confidentiality of login credentials and for activities occurring under the User's account. You must provide accurate, complete, and up-to-date registration information and promptly update it if it changes.

    3.7 Multi-User Access and Invitations: Where the App allows multiple authorized users, secondary users, or emergency contacts to be linked to the same Device or household, the primary account holder is responsible for inviting such persons lawfully. Lampsy may limit, revoke, or suspend shared access where necessary for security, privacy, safety, legal, or operational reasons.

    4. Subscription Payment and Withdrawal

    4.1 Lampsy App Subscription Tiers: Lampsy offers different subscription tiers, each with distinct features and capabilities. The subscription tiers available at the date of these Terms are described below:

    • Core - Allows Abnormal Movement detection notifications up to one emergency contact and one secondary user. Allows live video feed from anywhere, as long as there's a stable Wi-Fi network connection and no privacy settings are in place, save and access to in-app video recording of events for up to fifteen days.
    • Standard - Allows Abnormal Movement detection notifications up to three emergency contacts and three secondary users. Allows live video feed from anywhere, as long as there's a stable Wi-Fi network connection and no privacy settings are in place, and access to in-app video recording of events for up to two months.
    • Family - Allows Abnormal Movement detection notifications up to five emergency contacts and unlimited secondary users. Allows live video feed from anywhere, as long as there's a stable Wi-Fi network connection and no privacy settings are in place, save and access to in-app video recording of events for up to one year. Allows manual notifications to be deployed using the App. Enjoy sleep quality insights with the review your night feature. Lampsy covers up to one new Device per year in case of damage outside of the standard warranty.
    • Lifetime - Allows Abnormal Movement detection notifications up to five emergency contacts and unlimited secondary users. Allows live video feed from anywhere, as long as there's a stable Wi-Fi network connection and no privacy settings are in place, save and access to in-app video recording of events for up to one year. Allows manual notifications to be deployed using the App. Enjoy sleep quality insights with the review your night feature. Lampsy covers up to one new Device per year in case of damage outside of the standard warranty. The lifetime tier allows the user to access "High" tier perks with a one-time payment, as long as the system is still supported by Us.

    4. Subscription Payment and Withdrawal (continued)

    4.2 Features After Cancellation or Expiry: If your subscription is canceled or expires, you will not be able to access most of its capabilities, but you'll still have access to Abnormal Movement detection, basic notifications, and essential setup and Device operation features.

    4.3 Subscription Payment: You agree to pay all applicable fees, including any applicable taxes, related to your use of the App and/or the services that Lampsy provides via the App based on Lampsy's fees, charges, and billing terms then in effect. Lampsy will clearly display the total price (inclusive of all applicable taxes and charges) before you confirm any purchase or renewal. If you sign up for a paid subscription ("Paid Subscription"), we will charge you through your selected payment method for your first fee on the date that we process the order for your Paid Subscription.

    4.4 Eligibility to Purchase: You must be at least 18 years old (or the Age of Legal Capacity in your country) to purchase any item or service from Lampsy.

    4.5 Right of Withdrawal: You have the right to withdraw from the contract within 14 days of the date of purchase, without giving any reason and without incurring any costs other than as set out below. To exercise the right of withdrawal, you must inform Lampsy of your decision by means of an unequivocal statement (for example, by email to support@lampsyhealth.com, or through the App's cancellation function). The withdrawal period expires 14 days from the day on which the contract is concluded. If you withdraw from a Paid Subscription, Lampsy will reimburse all payments received from you, without undue delay and in any event no later than 14 days from the day on which Lampsy is informed of your decision to withdraw.

    4.6 Subscription Cancelation: Unless otherwise expressly stated at checkout or required by law, Paid Subscriptions renew automatically for successive renewal periods unless the User gives at least 15 days' notice of cancellation before the end of the then-current subscription term. Cancellation requests must be submitted in a clear statement to support@lampsyhealth.com or through the dedicated customer portal. Cancellation of a paid subscription does not automatically delete the User's Lampsy account or terminate this Agreement.

    4.7 Suspension and Termination for Cause: Lampsy may suspend, restrict, or terminate access to all or part of the Service, with or without prior notice, where reasonably necessary, if: (a) The User fails to pay amounts due and remains in default for at least 14 days after written notice; (b) Lampsy reasonably suspects fraud, misuse, unlawful activity, or security compromise; (c) continued provision of the Service may create a safety, privacy, legal, technical, or cybersecurity risk; (d) Lampsy is required to do so by law, court order, regulator, or a competent authority; or (e) The User materially breaches these Terms.

    4.8 Effect of Cancellation, Downgrade, Expiry, or Termination: Upon cancellation, downgrade, expiry, suspension, or termination: (a) The User's right to access subscription-only features shall end at the end of the current paid period; (b) any license granted under Section 3 shall automatically end to the extent it relates to paid or terminated functionality; (c) The User must stop using any part of the Service for which authorization has ended; (d) Lampsy may disable or deactivate Devices, accounts, or features associated with the ended subscription; and (e) Any amounts owed to Lampsy remain due.

    4.9 Data, Recordings, and Grace Period After Plan Changes or Termination: Where the User downgrades, cancels a Paid Subscription, or terminates the account, access to stored data may be reduced or removed. Lampsy will provide a grace period of up to 30 days after account termination during which the User will be able to export or retrieve eligible data. After that period, Lampsy may permanently delete or anonymize the relevant data, except to the extent retention is required by law.

    4.10 Price Changes: Lampsy may change the fees for the Paid Subscription from time to time. Any price increase will be communicated to the User at least 30 days before the start of the next renewal period. If the User does not agree to the new price, the User may cancel the Paid Subscription before the new price takes effect.

    5. Acceptable Use

    5.1 User Roles and Responsibilities: We recognize that Lampsy may be used by different individuals in different roles. If you are a Person with Epilepsy, you should be aware of and consent to the Device's operation. If you are a Caregiver or Parent, you are responsible for configuring and using the Device in the best interest of the Person with Epilepsy you are monitoring. If you are an Emergency Contact, you should familiarize yourself with what an Abnormal Movement detection call or message means. You may withdraw your consent to being an Emergency Contact at any time by contacting Lampsy directly at privacy@lampsyhealth.com. Regardless of role, all users must abide by these Terms.

    5.2 Improper Use: The User shall not use the Device or the App to (i) harm others, engage in any unlawful or fraudulent activity; (ii) damage, disable, overburden, or impair the App or related networks or servers; (iii) intentionally surveil, abuse, harass, stalk or otherwise violate the legal rights of a third party; (iv) share passwords or otherwise authorize any third party to access the App; (v) gain or try to gain unauthorized access to any data, account or network; or (vi) violate any applicable law.

    5.3 Age Restrictions: The Service is not intended for unsupervised use by minors. By accepting this Agreement, you represent and warrant that you are at least 18 years of age. If the Person with Epilepsy is a minor, a parent, legal guardian, or caregiver must set up the Device and manage the account.

    6. Warranty and Conformity

    6.1 Legal Guarantee of Conformity: Lampsy provides the mandatory legal guarantee for consumer goods as required by EU and Portuguese law. In the event of any lack of conformity that becomes apparent, Users are entitled to a warranty period of 3 years for the Device and, in respect of the digital elements of the Lampsy System supplied on a continuous basis, for the entire period of supply.

    6.2 Remedies for Lack of Conformity: During the legal guarantee period, if your Device is or becomes defective, you have the right to have the issue remedied at no cost to you. (a) First tier - repair or replacement. (b) Second tier - price reduction or termination. Any repaired or replaced product will have its warranty period of 3 years renewed.

    6.3 Conformity of Digital Elements: The App, the Subscription Service, and any firmware or software forming part of the Lampsy System are digital elements within the meaning of applicable law.

    6.4 How to Make a Warranty Claim: If you experience a problem with your Device, please contact our support through support@lampsyhealth.com or through the dedicated customer portal.

    6.5 Conditions Not Covered by Warranty: The legal guarantee does not cover defects or damage caused by: (i) misuse, neglect, or improper installation contrary to the Instructions for Use; (ii) damage caused by improper use; (iii) tampering or unauthorized alterations or repairs; (iv) use of third-party or incompatible accessories.

    6.6 Additional Commercial Warranty: Lampsy may offer an additional commercial warranty or service plan. Any commercial warranty does not limit or replace the mandatory legal guarantee.

    6.7 Post-Warranty Service: After the legal warranty period, if your Device encounters issues, you can still contact us. We may offer repair services or replacement parts for a fee if possible.

    6.8 Your Responsibilities: For the best experience with your Device, we recommend that you use the Device according to the Instructions for Use, perform basic maintenance, not attempt unauthorized repairs, and keep your proof of purchase. The above warranty provisions are consistent with EU consumer rights. In case of conflict between these Terms and applicable consumer law, the consumer law will prevail.

    7. Updates, New Versions, and Modifications

    7.1 Update Notification: Lampsy will provide software and firmware updates in accordance with Section 3.4.

    7.2 Modifications to these Terms of Service: Lampsy may modify or update these Terms from time to time for justified reasons. We will provide prior notice by email or through another durable medium at least 30 calendar days before any substantial change takes effect.

    8. Disclaimers

    8.1 Third-Party Communications and Interactions: You are solely responsible for all communications and interactions with persons with whom the App communicates or interacts as a result of your use of the App.

    8.2 Third-Party Apps: Lampsy is only responsible for apps under its own name and property.

    8.3 Service Availability: Lampsy will use commercially reasonable efforts to make the Service available on a reliable basis, but does not guarantee uninterrupted, continuous, timely, secure, or error-free availability.

    8.4 Internet and Data Charges: You are responsible for securing your own internet connection to use the Lampsy Device and App.

    8.5 Factors Affecting Notifications and Alerts: The User acknowledges that alerts, recordings, video access, calls, and notifications may be delayed, degraded, misdirected, or fail altogether for reasons including: (a) loss of power, internet, or Wi-Fi connectivity; (b) poor signal or bandwidth limitations; (c) the Mobile Device being switched off, offline, or configured to prevent notifications; (d) app permission settings or outdated software; (e) the emergency contact's Device being unavailable; (f) Device malfunction or improper placement; (g) failures affecting mobile carriers, SMS gateways, cloud providers, or push notification systems; and (h) force majeure or other causes beyond Lampsy's reasonable control.

    8.6 No Substitute for Direct Monitoring or Emergency Services: The Lampsy System is an assistive monitoring and notification tool only. It is not a substitute for direct supervision, prudent caregiving, emergency services, or professional medical assessment.

    9. Emergency Contacts and Notifications

    9.1 Adding Emergency Contacts: You may designate one or more Emergency Contacts in the App, who will be notified in case the Lampsy System detects an Abnormal Movement event. By adding someone as an Emergency Contact, you confirm that you have obtained their permission and informed them about the nature of such communications.

    9.2 How Notifications Work: When Lampsy's algorithm detects motion patterns indicative of a possible tonic-clonic seizure, the Lampsy System will send a notification to the Lampsy App and initiate an automated phone call to the designated primary Emergency Contact. If a notification fails, your Lampsy Device will emit an informative alarm.

    9.3 Limitation of Automated Calling: Lampsy is not a replacement for emergency services. The calls are directed to your private contacts, not to emergency services, ambulances, hospitals, or care units. We do not automatically dispatch medical responders.

    9.4 Accuracy and False Positives: Lampsy is designed to detect Abnormal Movement patterns consistent with its intended purpose, but no detection system is infallible. False positives, false negatives, delayed detections, and other inaccuracies may occur.

    9.5 Network Dependencies: Calling, messaging, push notifications, and related communications depend on third-party telecommunications and software networks. Lampsy cannot guarantee delivery or display of communications by third-party services.

    10. Limitation of Liability

    10.1 General Limitation: To the maximum extent permitted by applicable law, our aggregate liability towards you for any loss or damage arising out of or in connection with the Service shall not exceed the total amounts paid by you to Lampsy in the 12 months preceding the event giving rise to the claim, or the purchase price paid for the Lampsy System, whichever is greater.

    10.2 Exclusion of Certain Damages: Under no circumstances shall Lampsy be liable for incidental, special, indirect, consequential, or punitive damages.

    10.3 Exceptions: Nothing in these Terms shall limit or exclude Lampsy's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability which cannot be limited or excluded by applicable law, including mandatory consumer rights under EU law and Portuguese law.

    10.4 Limitation Does Not Apply Where Prohibited: Nothing in these Terms excludes or limits the mandatory rights of consumers under EU Directive 2019/771, EU Directive 2019/770, the Portuguese Consumer Law, or any other applicable consumer protection legislation. In the event of any conflict between these Terms and applicable mandatory consumer law, the consumer law will prevail.

    11. Intellectual Property

    11.1 Ownership: You acknowledge that all intellectual property rights relating to the Lampsy System belong to Lampsy Health, Lda. or its licensors. These rights remain with Lampsy, and these Terms do not transfer any ownership of intellectual property to you.

    11.2 Trademarks: Lampsy, Lampsy Health, the Lampsy logo, and other related marks are registered or unregistered trademarks of Lampsy Health, Lda. You may not use them without prior written permission, except as necessary to refer to the product in a factual, non-misleading manner.

    11.3 Feedback: If you submit suggestions, ideas, enhancement requests, feedback, or other communications regarding the Service, you acknowledge that such submissions are voluntary, non-confidential, and non-proprietary. Lampsy shall have a perpetual, irrevocable, worldwide, royalty-free right to use such feedback for any purpose, without any obligation to compensate you.

    12. Data and Privacy

    Lampsy processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation. By using the Lampsy System, you consent to such processing as described in the Privacy Policy. Lampsy may collect and use anonymized, aggregated, or de-identified data for research, analytics, product improvement, and other lawful purposes, without restriction. For full details on how your data is collected, processed, stored, and shared, please review Lampsy's Privacy Policy.

    13. Governing Law and Dispute Resolution

    13.1 Governing Law: This Agreement is governed by and construed in accordance with the laws of Portugal, without regard to its conflict of laws principles.

    13.2 Jurisdiction: Any disputes arising out of or relating to this Agreement shall be submitted to the competent courts of Portugal.

    13.4 Alternative Dispute Resolution: You may also seek resolution through a certified Portuguese consumer dispute resolution body. In Portugal, you may use the CNIACC or other accredited entities. Contact details are available at https://www.consumidor.gov.pt.

    14. General Provisions

    14.1 Entire Agreement: These Terms, together with the Privacy Policy and any applicable order confirmation, constitute the entire agreement between you and Lampsy relating to the Lampsy System and supersede all prior agreements.

    14.2 Assignment: You may not assign or transfer your rights or obligations under these Terms without Lampsy's prior written consent. Lampsy may assign its rights and obligations to a successor, affiliate, or acquirer without your prior consent, provided that the assignment does not materially reduce your rights.

    14.3 No Waiver: A failure by Lampsy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

    14.4 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

    14.5 Force Majeure: Lampsy shall not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure results from causes beyond Lampsy's reasonable control, including natural disasters, war, terrorism, epidemics, pandemics, telecommunications failures, power outages, cybersecurity incidents, or any event recognised under applicable law as constituting force majeure.

    14.6 Language: These Terms have been drafted in English. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
